The research aims to problematize the State policy of Basic and Professional Education of the State of Espírito Santo in view of the role of the "Living School" program in the development of the social right to education. This study is based on the Marxian conception that understands the human being as subject of his own history whose ontology is defined based on the category Work and the class struggle as the engine of social transformation. We have chosen methodologically to investigate the dialectical movement of reality and we use documentary analysis and field research based on interviews to understand the contradictions that emerge from our object of analysis. The research reveals the many interests that cross the institutionality and the materiality of the offer of the Right to High School and Vocational Education in the state of Espírito Santo. We contacted two movements of reality: a process of dismantling the state public offer of Technical High School Education Integrated to High School and another of hegemonization and implementation of the "Living School" program that occurs without due dialogue with the school community for Private interests of local elites. This non-dialogical practice of the current government of Espírito Santo promotes the disintegration of the right to Basic Education and Public Professional, dismantling comprehensive education policies in the name of a full-time school, which, in substance and in practice, Strengthens the relations between public and private in the school supply, reaffirming the business logic of privatizing management of education.
