- ItemA representação do gênero feminino nos autos criminais na província do Espírito Santo (1853-1870)(Universidade Federal do Espírito Santo, 2006-07-14) Mergár, Arion; Franco, Sebastião Pimentel; Campos, Adriana Pereira; Nader, Maria Beatriz; Pinto, Maria Ines Machado BorgesThis regional study provides subsidies for the understanding of images created by the society and by the Judiciary about the women in the province of Espírito Santo, in the nineteenth century, described in the criminal records of the Public State File of Espírito Santo, in which they appear as defendants. Based on the speeches collected from the accusation and defense witnesses or from the announcements of police and juridical authorities, it is glimpsed that, although it was desired an idealized model of women, compatible to submission, cautiousness and kindness, in the every day life, many of them are insurgent against this model. The initial chronological period was 1830, due to the edition of the Imperial Criminal Code, and the end was 1871, with the Law nº 2.033, when the police inquest was formally held, occasion when the judges and the appeals court judges stopped accumulating the functions of judiciary police. Almost all women under any kind of accusation were absolved. However, in a delimited time, the woman as defendant, appears only in the criminal records related to the period of 1853 up to 1870. However the Justice has absorbed these women, the witnesses’ reports make evident that, in the social environment where they are inserted, there was a natural condemnation by the fact of not being part of the idealized model.
- ItemEntre a reclusão e o enfrentamento: a realidade da condição feminina no Espírito Santo a partir dos autos criminais (1845-1870): desmistificando estereótipos(Universidade Federal do Espírito Santo, 2007-08-24) Souza, Alinaldo Faria de; Franco, Sebastião Pimentel; Soares, Geraldo Antônio; Nader, Maria Beatriz; Barreto, Sônia Maria CostaThe research aims at standing out that, although there was, in the Brazilian society and more particularly in the Espírito Santo Province, between 1845 and 1870, temporal period of this dissertation, an idealized model of woman, which should be reached, such model was based on the conformism, on the docility, on the cautiousness, attitudes which were matched with the idea of submission of the female gender toward the male one, whose last goal was to make difficult that the masculine power could be confronted by women, in practice, with all the involvement in conflicts and quarrels. In present indications to the legal briefs, the research searches for analyzing and understanding the stories, women’s life trajectories and thus reminding the role played by society. It concludes that the world which surrounded men and women in that period studied in the work was characterized by conflicts, tensions, and accommodations, furthermore it proves that not every women were easily deceived to the masculine dominance, quite the opposite, in many situations, they confronted the men, even physically. This research uses as resource the criminal hearings found in the Espírito Santo State Public File. It searches for, in the characters speeches that are part f the criminal hearings, either masculine or feminine, victims, tortures, witnesses, police or judicial officers, highlighting the way women living in the Capixaba society at that period, found gaps to assume a role far from the idealized cautiousness model, docility and submission.
